After a very very very long process with my case, I can finally say I’m relieved from my case. Such a helpful office. Very outstanding team. Great communication even if I was working most of the time. But they kept me up to date with calls, voicemails, texts and e-mails.

-Why motorcycle cases are different
Riders Get Hurt Worse, and Get Offered Less
In a car, people are buckled in inside a cab. On a motorcycle, you have no protection. Riders are often thrown from the bike into traffic, and far too many crashes are fatal.
Texas has large highways, high speed limits. Even the most careful rider is at risk when another driver is careless for a split second.
Insurers often see riders as thrill seekers. They use that bias to blame you and cut your claim. You need a lawyer who knows how to fight it.

What to Do After a Motorcycle Accident
The steps you take right after a crash protect your health and your case. Mistakes here can lead insurers to offer far less than you deserve.
01.
Call 911
See a doctor or paramedic, even for minor pain.
02.
Report the crash
A detailed police report strengthens your claim.
03.
Swap info

04.
Take photos
Your injuries, bike, skid marks, and road conditions.
05.
Avoid the adjuster
Their job is to limit your claim. Send them to us

Helmets
Required for riders and passengers under 21. If you’re older, you can still file a claim without one, but insurers may try to lower its value.
Full lane access
Motorcycles are entitled to the entire lane, just like any other vehicle.
License and insurance
Riders need a valid motorcycle license and at least the state minimum liability coverage.
Partly at fault?
You can still recover if you were not more than 50% at fault. Your award drops by your share.
20% at fault: you recover 80%

Motorcycle Accident Questions
Straight answers for injured riders and their families
How much does a motorcycle accident lawyer cost?
Garza Law works on a contingency-fee basis for qualifying motorcycle injury cases. You pay no upfront attorney’s fees, and we are paid only if we recover compensation for you. This allows injured riders to hire an experienced personal injury lawyer without having to pay attorney’s fees out of pocket while their case is pending.
What should I do after a motorcycle accident in Texas?
Your health and safety come first. Call 911, seek medical attention, and report the crash to law enforcement. If you are able, take photographs or video of the vehicles, motorcycle, roadway, skid marks, debris, traffic signs, and your injuries. Get the names and contact information of witnesses and exchange insurance information with the other driver.
Avoid giving a recorded statement to the other driver’s insurance company or signing documents before understanding your rights. Motorcycle crashes can involve serious injuries and disputed liability, so preserving evidence early can be important. Contacting a motorcycle accident lawyer as soon as possible can help ensure that evidence is preserved and the claim is properly investigated.
Do I need a lawyer if the other driver was at fault?
Yes. The insurance company may dispute fault, minimize your injuries, question your medical treatment, or argue that you contributed to the crash.
Motorcycle cases can be particularly challenging because insurers may attempt to place blame on the rider or rely on stereotypes about motorcyclists. An attorney can investigate the collision, preserve evidence, deal with the insurance companies, document your damages, and pursue the full compensation available under Texas law.
What compensation can I recover after a motorcycle crash?
The compensation available depends on the facts of your case and the extent of your injuries. A motorcycle accident claim may include compensation for medical expenses, future medical care, lost income or earning capacity, physical pain and suffering, mental anguish, physical impairment, disfigurement, and damage to your motorcycle and other property.
In cases involving especially serious misconduct, additional damages may also be available under Texas law. The value of any claim depends on the evidence, the injuries and losses involved, available insurance coverage, and the circumstances of the collision.
How long do I have to file a motorcycle accident claim in Texas?
In most Texas personal injury cases, a lawsuit must be filed within two years from the date the claim accrues, which in a typical motorcycle collision is the date of the crash.Law works on a contingency-fee basis for qualifying motorcycle injury cases. You pay no upfront attorney’s fees, and we are paid only if we recover compensation for you. This allows injured riders to hire an experienced personal injury lawyer without having to pay attorney’s fees out of pocket while their case is pending.
What if I was not wearing a helmet or was partly at fault?
You may still have a claim. Texas law does not require every adult motorcycle rider to wear a helmet. Riders who are at least 21 may qualify for an exception to the helmet requirement if they have completed an approved motorcycle safety course or have qualifying health insurance coverage.
Even if you were legally required to wear a helmet, not wearing one does not automatically mean you caused the collision. Whether helmet use is relevant to a particular injury or damage claim depends on the facts and evidence in the case.
Texas also follows a modified comparative-responsibility system. You can generally recover damages if you are 50% or less responsible for the accident, although your recovery can be reduced by your percentage of responsibility. If you are found more than 50% responsible, Texas law bars recovery.
