    The app status matters

One crash can involve more than one insurance policy

The coverage available after an Uber or Lyft crash may change depending on what the driver was doing in the app at the moment of impact. That is why the trip record and app status should be checked early.

    1App off

The driver’s personal auto policy will usually be the starting point.

    Personal policy

    2Logged in and waiting

Rideshare coverage may apply, but the available coverage can differ from coverage during an active trip.

    Contingent

3Ride accepted or passenger on board

Higher platform-arranged liability coverage may apply, depending on the facts, fault and policy terms.

    Platform-arranged

The bars above show how these three situations compare to one another. They are not coverage amounts and this page is not a coverage calculator. What is actually available depends on the crash facts, the policy terms and applicable law.

    Who we help

Rideshare crashes affect more than passengers

    Passengers

You may have a claim even when you do not know which driver caused the crash.

    Rideshare drivers

Your options can depend on fault, app status and the coverage you carried yourself.

    Drivers in other vehicles

You may be able to pursue the at-fault driver and any applicable rideshare coverage.

    Pedestrians and cyclists

App records can help establish whether the driver was working through the platform when the collision occurred.

What to do after a rideshare crash

Protect your health and preserve the trip information

The trip record is the part most people lose. It is worth saving before anything else disappears from easy view.

    1. Get medical help. Call 911 for urgent injuries and seek prompt evaluation if symptoms appear later.
    2. Report the crash. Ask for the police report number and report the incident through the rideshare app when you are able.
    3. Save the trip record. Screenshot the driver, vehicle, route, receipt, pickup and drop-off information before it disappears from easy view.
    4. Document the scene. If it is safe, photograph the vehicles, damage, roadway and visible injuries. Save witness contact information.
    5. Be careful with releases. Understand what an insurer is asking you to sign before accepting a settlement or releasing a claim.

    Who may be responsible

We look beyond the name on the rideshare app

Responsibility depends on how the collision happened. In some cases, more than one person, company or insurance policy may be involved.

    • The rideshare driver, if unsafe driving caused or contributed to the crash
    • Another driver who caused the collision
    • An owner or employer connected to another involved vehicle
    • A manufacturer or repair provider when a defective part or negligent repair contributed to the crash
    • Applicable personal, commercial or platform-arranged insurance coverage

A rideshare platform is not automatically legally responsible for every crash. The available claims and insurance coverage must be evaluated from the specific facts.

    Compensation

A claim should account for what the crash has already cost you and what it may cost later

Depending on the evidence and Texas law, recoverable damages may include:

    • Emergency treatment, hospital care, rehabilitation and other medical expenses
    • Reasonably necessary future medical care
    • Lost income and reduced earning capacity
    • Vehicle and other property damage
    • Physical pain, impairment, disfigurement and mental anguish
    • Wrongful death damages for qualifying family members when a crash is fatal

The value and availability of damages depend on the facts of the case. No lawyer can promise a particular result.

How Garza Law handles the claim

We identify the coverage before the insurers define the claim for you

    • Confirm the rideshare driver’s app status and trip timeline
    • Collect available crash reports, photographs, video, witness information and platform records
    • Identify the people, companies and insurance policies that may be involved
    • Document medical care, lost income and the ways the injuries affect daily life
    • Handle communications and negotiations with insurers
    • Prepare the case for litigation when filing suit is appropriate

    Frequently asked questions

    Rideshare claims in Texas

Short answers to what people ask before they call. None of it replaces advice about your own crash.

What does it cost to hire Garza Law?

The case review is free. We handle injury claims on a contingency-fee basis, which means you do not owe a legal fee unless we recover compensation for you. Ask us to explain the fee agreement and case expenses before you hire the firm.

Which insurance company pays after an Uber or Lyft crash?

It depends on who caused the collision and what the rideshare driver was doing in the app. A claim may involve the driver’s personal policy, coverage arranged through the rideshare platform, another driver’s insurer or more than one policy.

Can I make a claim if I was an Uber or Lyft passenger?

Possibly. Passengers are rarely responsible for causing the collision, but the correct claim still depends on which driver was at fault and what insurance coverage applies.

What if the rideshare driver was logged in but had not accepted a ride?

That app status matters because the available coverage may be different from the coverage during an accepted trip. Save any screenshots or records that help establish the driver’s status and contact an attorney for a case-specific review.

What if the at-fault driver was uninsured or left the scene?

There may still be coverage available, including uninsured or underinsured motorist coverage, depending on the policies and circumstances. These coverages vary, so the policy documents should be reviewed rather than assumed.

How long do I have to file a rideshare accident claim in Texas?

Many Texas personal injury lawsuits are subject to a two-year filing deadline, but exceptions can shorten or extend the time available. Waiting can also make evidence harder to obtain, so it is better to ask about the deadline promptly.
